This electronic record is generated by a computer system and does not require any physical or digital signatures.
These Terms and Conditions / Terms of Service (“Terms of Maruti Packaging” / TOS / Website Terms) read with the privacy policy, disclaimers, rules of Maruti Packaging as may be posted on this Website, having domain name http://93.127.167.98:8069/, from time to time, shall govern your use/access of the Website, (“Website”), its related content, sites and hyperlinks owned maintained and operated by Maruti Packaging. and or its Affiliates and the domain name is owned by one of its Affiliates. These Terms applies to all Users of the Website.
By impliedly or expressly accepting these Terms, privacy policy, you also accept and agree to be bound by rules, policies and Terms of Maruti Packaging as posted on this Website from time to time and corresponding hyperlinks if any. If you do not agree to be bound by the TOS, please do not access this Website or avail any Services provided through this Website.
Changes to the Website Terms
We may change, modify, amend or update the Website Terms from time to time by publishing an updated version on the Website. By continuing to use the Website you will be deemed to accept the updated Website Terms and agree to be bound by them.
- PAYMENT TERMS & CONDITIONS
1. Payment Due Date
All payments must be made within the due period mentioned on the invoice unless otherwise agreed in writing.
If no specific due date is mentioned, payment shall be made within 30 days from the invoice date.
2. Late Payment Charges
Any payment not made within the stipulated time shall attract interest @ 1.5% per month (18% per annum) on the outstanding balance, calculated from the invoice date until full and final payment is received.
3. Additional Recovery & Legal Charges
In case of delay, default, or non-payment, Maruti Packaging reserves the right to recover all additional costs incurred, including but not limited to:
- Legal notice charges
- Advocate fees
- Court expenses
- Recovery agency charges
- Collection and follow-up expenses
All such charges shall be fully payable by the customer.
4. Mode of Payment
Payments may be made via bank transfer, cheque, UPI, or any other mutually agreed mode
5. Cheque Dishonour Charges
In the event of cheque bounce/dishonour for any reason (including insufficient funds, account closed, etc.):
- ₹500 processing charge
- Applicable bank charges
- Legal action under the Negotiable Instruments Act, 1881
shall be applicable.
6. Security Cheque Clause (VERY IMPORTANT)
Any cheque provided by the customer (including blank/security cheque) may be used by Maruti Packaging towards recovery of outstanding dues.
The customer authorizes Maruti Packaging to fill in the amount equivalent to legally recoverable dues and present the cheque for encashment.
7. Dispute Resolution
Any dispute regarding the invoice must be raised within 7 days of receipt of the invoice.
Failing which, the invoice shall be deemed accepted in full and final, and no disputes shall be entertained thereafter.
8. Acceptance of Terms
By accepting delivery of goods/services or making any payment, the customer is deemed to have read, understood, and accepted all terms and conditions of
Maruti Packaging.
9. Jurisdiction
All transactions are subject to the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat.
⚠️ 10. Modification of Terms (IMPORTANT FIX)
Instead of writing “we can change anytime” (which is weak legally), use this:
Maruti Packaging reserves the right to modify or update these terms from time to time.
However, the terms applicable to any transaction shall be those in effect at the time of invoicing or order confirmation.
- Delivery and Ownership
- Ownership of goods remains with Maruti Packaging until full payment is received.
- Delivery dates are approximate and may vary due to unforeseen factors such as raw material availability, production delays, logistics issues, or force majeure events.
- Risk and responsibility for goods transfer to the buyer upon delivery or dispatch.
- Taxes & Duties
- All quoted prices are exclusive of GST and other applicable taxes unless otherwise stated.
- Any taxes, duties, or government levies imposed shall be borne by the buyer.
- Design Approval & Production Timeline
- Once the design, artwork, or layout is approved by the customer, no further changes shall be accepted.
- Production and dispatch will begin only after final design approval and submission of required documents, such as GST details, PO, or artwork confirmation.
- The delivery timeline is 15–20 working days from the date of final approval and receipt of all required information.
- The customer is solely responsible for the correctness of all artwork, spelling, design content, and information submitted for printing.
- Maruti Packaging will not be held liable for errors, color variations, or design issues after customer approval.
- All approved artworks remain the property of the client, but Maruti Packaging retains the right to display printed samples for portfolio or marketing purposes unless otherwise requested in writing.
- Order Cancellation & Modifications
- Cancellations or modifications must be communicated in writing within 3 days of placing the order.
- Cancellations made after this period may incur charges for materials, labor, or printing work already completed.
- Any advance payment made may be adjusted against such charges as deemed reasonable by Maruti Packaging.
- Returns & Claims
- Claims for defects, damages, or shortages must be made within 7 days of receipt of goods.
- Goods returned without prior written approval will not be accepted.
- Maruti Packaging reserves the right to repair or replace defective goods at its discretion.
- Claims related to mishandling, improper storage, or transit damage after delivery will not be entertained.
- A tolerance of ±5% in quantity, size, or color shall be deemed acceptable due to production and printing variations.
- Warranty
- The goods supplied are warranted to meet the agreed-upon specifications at the time of delivery.
- No other warranties, express or implied, are made regarding the performance, usability, or merchantability of the products beyond those stated herein.
- Force Majeure
- Maruti Packaging shall not be liable for any delay or failure to perform obligations due to causes beyond its control, including but not limited to natural disasters, strikes, machinery failure, transportation delays, raw material shortages, or government actions.
- Confidentiality
- All information, artwork, pricing, and correspondence shared between Maruti Packaging and the client shall be treated as confidential.
- Neither party shall disclose such information to any third party without written consent.
- Jurisdiction
- All disputes arising out of or related to these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Surat City, Gujarat, India.
- Severability
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Quotation Validity
- All quotations are valid for 15 days from the date of issue unless otherwise specified in writing.
- Intellectual Property
- Maruti Packaging retains the right to use images of printed or manufactured products for marketing, portfolio, or website display purposes, unless specifically prohibited by the client in writing.
